1. Who these Terms cover
These Terms of Service ("Terms") govern your use of the website fynnswood.com (the "Site") and any purchase you make from Fynn's Woodworking & Designs ("we," "us," "our"), whether that purchase happens on this Site or through one of our storefronts on Etsy, Square, TikTok Shop, Snapchat, or any other marketplace we sell on (each, a "Marketplace" — see Section 12).

By placing an order, creating an account, or otherwise using the Site, you agree to these Terms. If you don't agree, please don't use the Site or place an order.

2. Who can use the Site
You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm you're old enough to form a binding contract and that any payment method you use is your own or you're authorized to use it.
3. Products, descriptions, and availability
We make reasonable efforts to describe and photograph our products — cutting boards, tumblers, knives, keychains, and other laser-engraved and woodworking goods — accurately, including materials, dimensions, and finish. Because many items are handmade or laser-engraved to order, small variations in wood grain, color, and engraving depth between the photo and your finished item are normal and are not defects.

Where a product listing shows an example of engraved artwork or text, that image is a representative example only — your finished item will carry the design or text you submit or select, not the exact sample shown, unless you order the item exactly as pictured.

We reserve the right to limit quantities, refuse or cancel any order (including after it's been placed), or discontinue a product at any time, including orders that appear to be fraudulent, that request content we decline under Section 6, or that we're unable to fulfill due to material or capacity constraints. If we cancel an order you've already paid for, we'll refund you in full.

4. Pricing and payment
Prices are listed in U.S. dollars and are current as of the time you view the listing; they may change without notice, but the price you're charged is the price shown at checkout at the time you place your order. Any applicable sales tax, and any personalization/conversion fee described in Section 5, is added at checkout.

Payment is due in full at the time of order. We accept the payment methods presented at checkout on each Marketplace we sell through (for example, major credit/debit cards, and any digital wallets or installment options that Marketplace supports). Payment processing is handled by our payment processor or the relevant Marketplace, not stored by us — see our Privacy Policy for details.

5. Custom and personalized orders
Many of our products are made or engraved to order based on the text, artwork, or design you provide, or a design of ours that you select. Because of this, custom orders work a little differently than off-the-shelf purchases:

Proofs. Before we produce a personalized item, we'll send you a digital proof showing the text/artwork as we intend to engrave it. Production does not begin until you approve that proof. We aim to turn proofs around within 1 business day of receiving your artwork.

Turnaround. Personalized items generally ship 7–10 business days after you approve your proof, not from the order date. This may be longer during holidays or high-volume periods, which we'll note on the Site when it applies.

Artwork conversion fees. If your submitted artwork needs to be cleaned up or converted for engraving, a conversion fee may apply, shown to you before you're charged: no fee for text-only or already high-resolution/vector artwork; a fee for simple cleanup of lower-resolution artwork; and a custom quote — confirmed with you before any charge — for complex or poor-quality artwork. "High resolution" means a vector file, or a raster image at least 1000 pixels on its long edge.

Accuracy is on you. We engrave what you approve in the proof. Please check spelling, names, dates, and placement carefully before approving — once you approve a proof, we're not responsible for errors that were present in the approved proof itself. If we make an engraving error that doesn't match your approved proof, we'll fix it at no cost to you.

Final sale after approval. Because personalized items can't be resold once made, all sales are final on personalized items once you approve your proof and production begins, except where the item arrives damaged, defective, or doesn't match your approved proof — see our Refund Policy for the full return terms on both personalized and non-personalized items.

6. Your artwork, and what we won't engrave

If you submit your own text, image, logo, or design for us to engrave ("Your Content"), you retain ownership of it. By submitting it, you:

confirm that you own it, or have the legal right to use and reproduce it (including any copyrighted image, trademark, or licensed character);

grant us a limited license to reproduce, adapt (for engraving/production purposes only, e.g., vectorizing or resizing), and store Your Content solely to fulfill your order and, unless you tell us otherwise, to show the finished piece as an example of our work; and

agree to indemnify us against any claim arising from Your Content infringing someone else's rights — see Section 11.

We reserve the right to decline to produce any order containing content that is illegal, infringes a third party's intellectual property or trademark rights, is hateful, obscene, or defamatory, or that we otherwise reasonably believe exposes us to legal risk. If we decline your order for this reason, we'll refund any payment already made for it and let you know why.
7. Shipping
We ship the items you order to the address you provide at checkout. Shipping costs, carriers, and estimated timelines are set out in our Shipping Policy, which is incorporated into these Terms. You're responsible for providing an accurate shipping address; we're not responsible for orders delayed or lost because of an incorrect address you provided, though we'll help you work with the carrier where we can.
Risk of loss and title for items you purchase pass to you when we hand the package to the carrier.
8. Returns, exchanges, and refunds
Our full return, exchange, and refund terms — including the 30-day window for non-personalized items and the final-sale terms for approved personalized items — are set out in our Refund Policy, which is incorporated into these Terms. Please contact us at justin@fynnswood.com before sending anything back so we can give you return instructions.
9. Acceptable use of the Site
When using the Site, you agree not to: use it for any unlawful purpose; attempt to gain unauthorized access to our systems or another user's account; interfere with or disrupt the Site's operation (including via bots, scrapers, or malware); copy, reproduce, or resell our product photography, descriptions, or original designs without permission; or submit false information when placing an order.
10. Intellectual property
Except for Your Content (Section 6), all text, graphics, logos, product photography, and original designs on the Site are owned by us or our licensors and are protected by copyright and trademark law. You may view and download material from the Site for your own personal, non-commercial use, but you may not otherwise copy, reproduce, distribute, or create derivative works from it without our written permission.
11. Disclaimers and limitation of liability
Disclaimer.
To the fullest extent permitted by law, the Site and our products are provided "as is" and "as available," without warranties of any kind, express or implied, except for any warranty that can't be excluded under Texas or federal law. Handmade and wood products naturally vary in grain, color, and finish; we don't warrant that engraved artwork will be pixel-identical to a digital proof, only that it will match the proof's content in substance.
Limitation of liability.
To the fullest extent permitted by law, our total liability to you for any claim arising from your order or use of the Site — whether based on contract, warranty, tort, or any other legal theory — is limited to the amount you paid us for the specific order giving rise to the claim. We're not liable for indirect, incidental, special, or consequential damages (like lost profits or lost data), even if we've been advised they're possible. Nothing in these Terms limits liability that can't be limited under applicable law, including liability for gross negligence, fraud, or a defective product that causes personal injury as governed by Texas product liability law.
Indemnification.
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from: your breach of these Terms; Your Content infringing a third party's rights (Section 6); or your misuse of the Site or a product you ordered.
12. Third-party Marketplaces
We sell through our own Site as well as through third-party Marketplaces, including Etsy, Square, TikTok Shop, and Snapchat. When you buy from us through one of those Marketplaces:

that Marketplace's own terms of service, buyer protection policies, and payment terms apply to that transaction, in addition to the product-specific terms in these Terms of Service (custom order handling, our returns/shipping policies, and Sections 3–8 above), to the extent that Marketplace allows a seller's own policies to apply;

if a Marketplace's terms directly conflict with these Terms for a transaction made on that Marketplace, the Marketplace's terms govern for anything specific to using that platform (like its checkout, buyer-protection program, or dispute process), while our product, custom-order, and IP terms above still describe how we make and stand behind what we sell; and
-
these Terms, in full, govern any purchase made directly on fynnswood.com.

13. Privacy
Our Privacy Policy describes what information we collect when you use the Site or place an order, and how we use, store, and protect it. It's incorporated into these Terms by reference.
14. Changes to these Terms
We may update these Terms from time to time, for example to reflect a new product line, shipping change, or legal requirement. We'll post the updated Terms here with a new "Last updated" date. Changes apply to orders placed after the update; they don't change the terms that applied to an order you already placed.

15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your order that isn't resolved informally will be subject to the exclusive jurisdiction of the state or federal courts located in Real County, Texas, and you consent to personal jurisdiction there.
